Organisational IP Knowledge Explained – (Clause 7.1.6)

One of the new requirements of ISO 9001:2015 includes the need for management of organisational knowledge (clause 7.1.6). Knowledge Management is a subject that came to the fore during the early 1990’s and now comprises a discipline in its own right. It is no wonder then, that it has been included in the latest version of ISO 9001.

“Knowledge is defined by the Oxford Dictionary asfacts, information, and skills acquired through experience or education; the theoretical or practical understanding of a subject.  In a nutshell, we might say that knowledge management is the process by which knowledge is gathered, held and disseminated, as ‘know-how’, to those who are accountable to achieve an objective. It can be “boxed” and sold as a valuable commodity for a price depending on its market value and market demand.

When considered in the context of the ISO 9001:2015 standard, the requirements of 7.1.6 Organisational knowledge cannot be read in isolation, since this will minimise the usefulness of this part of the standard.”

To develop a quality management system, the organisation is required to consider the context of its existence, both in terms of the factors influencing it or that it can influence, including the needs of interested parties (see clause 4). These strategic factors influence the definition of its objectives, including quality objectives, as well as the processes that it uses to achieve these objectives (see clause 6).

Since ‘The organisation shall establish quality objectives at relevant functions, levels and processes’ (clause 6.2.1), those who are accountable to achieve these objectives require the full ‘know-how’, or they may miss the mark.

The clause therefore requires that the knowledge that is required is determined, held in a current format, and shared with those who need it to do their job. This includes obtaining new or changing existing ‘know-how’ as circumstances change, from strategic through operational levels.

Although the notes associated with clause 7.1.6 are not audit-able, there are strong suggestions that knowledge is sourced far and wide and typically goes way beyond the traditional content of documented process procedures.

We know that knowledge gained by experience is often lost when key players leave an organisation. This too forms a part of the intent behind knowledge management.

Organisations that do well at knowledge management often have powerful information technology systems that are able to mine existing data, irrespective of where it resides, combine this with real-time communication, and deliver it to those who need it in a timely manner. Social media often has a role to play to access organisational knowledge from subject matter experts within the organisation.

Although smaller organisations may not have the need or resources to deliver the best practice examples mentioned above, the clause certainly requires that a deeper investigation is made to ensure that the ‘know-how’ is at the point of action throughout the organisation.

15Why not buy an existing business or a ‘going concern’?

Often an existing business has hidden problems, which the seller does not reveal to the buyer. And they are only discovered once the business has been bought and paid for. And then it is either too late to resolve and a lot of money can be wasted and even lost. What sort real expertise can I expect in the ‘start up’ of my new business?

The IP / Knowledge agreement on offer – results from an actual production business in this industry that we all held a management position in and physically managed ourselves. So the training and experience are all first hand and hands on.

What if I do not require the technical expertise and machinery as I am proficient in these matters and have my own businesses?

This is not compulsory as many of you may have a good business background or already be technically skilled and just want the IP to produce the product, in which case we then sell the information only and you take it from there.


Am I not tied to BizNiz Unboxed for life? Because, I have bought an agreement to their Intellectual Property?

Not at all! You are buying the ‘once off rights’ to have full access to the Intellectual Property and full set up knowledge and assistance for your business.  But, you may trade under your own chosen name and you are the full owner of your company. But, you may not ‘on sell’ the Intellectual Property as it belongs solely to BizNiz Unboxed at all times. But you do have full and unlimited access and use of the “IP” at all times and how you use it or modify it – or where and who you trade with is entirely up to you. Once we have assisted you, if necessary, to set the business up and you are trading successfully – you become the captain of your own ship.

Can I move my business to another area if I so choose?

Again, we emphasize that the company is yours and you may move the business at any time.


How well has this business model been tested, in other words, what is the history of actual success?

The painted model has been tested and run over 25 years with excellent product results. Romero is in its 3rd generation of vehicle type and the research, testing, production and sales have always proved to be exceptional. In 2009, it won the SABS Best New Car Design of the Year award.    It has huge market potential.


Do I have to stick to the name of either Umbala Paints or Romero Automotive or can I trade under any name that I so choose?

You are completely free to name your business as you so choose and you may trade under any name that you register with the relevant Government Body.
